Supreme Court Judgement Jat Reservation Cancelled
The Supreme court of India set aside the notification issued by the erstwhile UPA Government to include jats in the Central List of Other Backward classes for according benefites of reservation to them " We set aside the notification to implement Jats in Central list of Other Backward Classes (OBC)" a bench of Tarun Gogoi and Justice R G Nariman Said.
The bench alos found fault with the Centre's decision to overlook the finding of the National Commission for Backward classes stating that Jats do not deserve to be included in the Central list of OBC as the don't form socio economic backward class.
"Caste, though a prominent factor, can not be the sole factor of determining the backward classes of a class," the bench said, while referring to the historic judgement rendered by a larger bench on the the implementation of the Mandal Commission recommendation on OBC reservation.
The decision came on a public interest litigation filed by the OBC Reservation Raksha Samiti.
